These may be subject to change at our discretion and without prior notice. If you are not in agreement with these Terms and Conditions then you are not permitted to use this website, any of its contents and in particular its carbon footprint calculator.
    • 1.2 By purchasing carbon offsets from Carbonica Limited you enter into a legally binding agreement described by these Terms and Conditions. Please read them carefully in order to understand how they affect your rights and liabilities.

    • 2.1 Carbonica Limited is an International Business Company (IBC) registered in the Republic of Seychelles, registration no 49008, registered office at Oliaji Trade Centre, PO Box 1312 Victoria, Mahé, Seychelles.
    • 2.2 Carbonica Limited is a global company for the sale of carbon offsets worldwide. It owns and operates Carbonica Limited in London, which administers customer services and general enquiries for Carbonica Limited IBC; Carbonica Limited is registered in England and Wales, registration no 6558544, registered office at Empire House, 175 Piccadilly, London W1J 9TB, United Kingdom.
  3. Definitions and interpretation

      3.1 “The Company” denotes Carbonica Limited IBC.

      3.2 “The Website” denotes the Company’s website www.carbonica.org, including its aliases and linked domain names also owned by the Company. It also denotes its entire content, including the carbon footprint calculator.

      3.3 The “Calculator” denotes the carbon footprint calculator on the Website, including all its sections, icons, calculation formulae, software, databases, applications and content.

      3.4 “Us” denotes the Company.

      3.5 “You” denotes the customer, purchaser or user of the Company’s website.

  4. Disclaimer

      6.1 The Company makes no warranties of any kind as to the operation and contents of the Website. The Company has made every effort to verify the accuracy, quality of the cited sources and scientific rigour of the content on the Website, but cannot be held responsible for any inaccuracy or errors, whether explicit or implied. The Company will endeavour to rectify any inaccuracies or errors, and update content in keeping with new scientific developments, in order to maintain the highest standards at all times.

      6.2 The Company will not be liable for any damages of any kind arising from the use of the Website, including but not limited to direct, indirect, accidental, incidental, punitive or consequential damages.

      6.3 The Company, by virtue of the laws of the Republic of Seychelles governing International Business Companies, is not allowed to carry on business in Seychelles. Therefore you are not authorised to place an order on the Website or use the Calculator if you access it from Seychelles.

The Company will not be held responsible for any liability or damages arising from any course of action, direct or indirect, or any interpretation whether explicit or implied of the contents of the Website that results in a legal liability.

    • 7.1 All content on the Website, including but not limited to text, images, animation, software, video clips, logos, graphics, icons, carbon footprint calculator, scientific research content, creative concepts and all other original content, is the property of the Company (or its content suppliers, where applicable) and all rights are reserved and protected under UK and international copyright laws.
    • 7.2 The Calculator can be used only and exclusively as a shopping resource for the purposes of offsetting carbon emissions with us and the content of the Website can be used only and exclusively as a reference and educational resource on the subject of climate change. Without limiting the rights under copyright reserved above, no part of the Website may be reproduced, modified, distributed, transmitted, republished, in any form or by any means (electronic, mechanical, photocopying, recording or otherwise), without prior written permission of the copyright owner.
  6. Jurisdiction

    • 8.1 These Terms and Conditions are subject and governed by English law. The Company will use English law as an exclusive reference for its Terms and Conditions and general conduct of business, and will abide by all UK and European directives governing the sale of carbon offsets.
    • 8.2 By using the Website you irrevocably agree to submit exclusively to the jurisdiction of the courts of England and Wales. You also agree that in the event of any dispute arising in connection with the use of the Website, including in relation to the validity of these Terms and Conditions, the Company may require you to submit your dispute for arbitration in England. All arbitration will be carried out in English by a single arbitrator and English courts may support and assist in this process.
  7. Data protection and privacy

    • 9.1 The Company collects and processes personal data on the Website for the following purposes only:
      1. To provide a service of sale of carbon offsets and to administer an after-sales customer relationship.
      2. To confirm and verify your identity, which may involve the use of a credit reference agency on behalf of the payment processing agent.
      3. For the purposes of detection, investigation or prevention of fraud or any form of malpractice.
    • 9.2 The personal data may be disclosed:
      1. To any regulator, service provider, government or law enforcement agencies or any person the Company reasonably thinks necessary for the purposes stated in 9.1c.
      2. To any partner organisation for the purposes of audit and business administration.
      3. To actual or potential purchasers of the Company and their agents and in relation to the transfer of our contractual rights and obligations.
    • 9.3 Your personal data will not be disclosed to third parties for commercial purposes.
    • 9.4 The Company will process all personal data under strict compliance with the Data Protection Act 1998.
  8. Cookies

    • 10.1 The Website uses session cookies, which are temporary cookies that remain in the cookie file of your browser until you leave the Website. This assists your navigation by carrying information across pages to avoid re-submitting it each time to view a page.
  9. Terms of purchase

    • 11.1 You understand that by completing the purchase on the Website you submit an order for carbon offsets to the Company, and your card details will be processed for payment.
    • 11.2 We will send you an email confirming the order and the amount charged.
    • 11.3 Our currency is the British pound (£) and the Calculator and shopping basket will display at every stage the cost to offset in this currency.
    • 11.4 The Company is offshore and therefore no VAT is payable on your order.
    • 11.5 You understand that your order with the Company is to carry out carbon offsets by funding tree planting, reforestation and other programmes via the Company’s partners and associated companies.
    • 11.6 We will aim to write to you by email within 24 hours of receipt of your order, providing details of the programmes that will provide the carbon offsets. The Company and its partners will aim to fund the programme within 2 months of confirmation of your order.
    • 11.7 We will write to you once the carbon offset is confirmed stating the location and details of the programme. You will receive an email containing a non-transferable certificate confirming the carbon offsets for your order.
    • 11.8 You understand that carbon offsets through carbon capture from the atmosphere is a process that is implemented over a span of time. The certificate issued for your purchase indicates that the carbon offsets will be carried out over a future cycle and it is not proof that the carbon offsets are carried out immediately.
    • 11.9 The Company does not own the land, trees or any physical element of the programmes that are carried out for the purposes of the carbon offsets. You understand that the programmes are funded through local communities, who are the sole beneficiaries of the physical by-products of the programmes, such as timber and harvests of any kind.
    • 11.10 You understand that the purchase of carbon offsets from us does not represent a freehold or entitlement to any rights or entail any liabilities or responsibilities direct or indirect over trees, land, harvests or any physical goods or by-products of the programmes funded for the purposes of the carbon offsets.
    • 11.11 We are committed to guaranteeing the carbon offsets are carried through to completion and therefore we will aim to review the programmes once a year. You will be informed by email of the progress of your carbon offsets but you can opt out from receiving this information.
    • 11.12 We will reinstate any programmes that have been disrupted and restore any damaged trees or plants whose capacity of carbon capture has been diminished. The Company will regularly reassess the various programmes and identify the optimal locations and programmes for future funding. The Company reserves its right to relocate the carbon offsets to another programme or another location at its sole discretion without prior notice.
    • 11.13 The certificate of carbon offsets sent to you by us is not for resale.
  10. Cancellation policy

    • 12.1 You are entitled to a full refund within a 28-day period from the confirmation of your order if for any reason you wish to cancel your order.
